By downloading, accessing, or using the OpenClaw / MacClaw software, website, or associated services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

OpenClaw is an open-source, local-first AI automation application. We provide the software "as is" for download and use on your personal or business devices. We also offer a website for managing your account and an optional paid subscription service (MacClaw Pro) that provides simplified access to third-party AI APIs.

3. Open Source License

The core OpenClaw application is open-source software. Your use, modification, and distribution of the open-source components are subject to the terms of the applicable open-source license provided with the software (e.g., MIT License) in our GitHub repository.

4. User Accounts and Authentication

To use certain features of the website (such as managing a Pro subscription), you must register for an account. We utilize third-party authentication providers (such as Google OAuth) for this purpose. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

5. Acceptable Use

You agree not to use the Service in any way that is unlawful, illegal, fraudulent, or harmful. You specifically agree not to use the automation features of OpenClaw to:

  • Violate the terms of service of third-party websites or API providers.
  • Engage in unauthorized data scraping, spamming, or harassment.
  • Distribute malware or execute malicious code.

6. MacClaw Pro Subscription

If you choose to subscribe to MacClaw Pro, you agree to pay the stated subscription fees. Subscriptions are billed on a recurring monthly basis. You may cancel your subscription at any time. We reserve the right to modify subscription fees or quotas with reasonable advance notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. Because OpenClaw automates software on your computer, you use it at your own risk. We are not responsible for unintended actions, data loss, or consequences resulting from the AI's operation on your device.

8. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
